1. Identification of Culpass
In compliance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), the User is hereby informed of the following information about the owner of the website:
- Company name: CULPASS, S.L.
- NIF: B67902593
- Registered office: C/ Teresa Berganza, 76, 28200 San Lorenzo de El Escorial (Madrid)
- Email: sales@culpass.com
- Website: www.culpass.com
2. Definitions
For the purposes of these General Purchase Conditions (hereinafter, the "GPC"), the following terms shall have the meaning indicated:
- CULPASS or the Platform: CULPASS, S.L., owner of the website www.culpass.com, which acts as a technology intermediary in the sale of tickets.
- User or Buyer: natural person over 16 years of age who purchases one or more tickets through www.culpass.com to attend an Event.
- Organizer: natural or legal person who has created an Event on the Platform and puts tickets for it on sale. The Organizer is the provider of the service of access to the Event.
- Event: any occasion, activity, show, course, conference, workshop or meeting created and managed by an Organizer through the Platform, to which the User may gain access by means of a ticket.
- Ticket: access pass, in digital format with a QR code, which proves the User's right to attend a specific Event under the conditions established by the Organizer.
- Organizer's Partners: third parties designated by the main Organizer of the Event as collaborators or co-organizers. Their identity is determined by the Organizer and is unrelated to CULPASS.
3. Purpose and Scope of Application
3.1. Purpose
These GPC govern the relationship between the User, the Organizer and CULPASS in the process of purchasing Tickets for Events through www.culpass.com. Acceptance of these GPC is a prior and essential requirement to complete any purchase on the Platform.
These GPC are supplemented by the CULPASS Privacy Policy and Cookies Policy, available in the footer of the website, which form an integral part of the legal framework applicable to the relationship with the User.
3.2. Territorial scope
www.culpass.com is available for the purchase of Tickets by persons from any country in the world. However, Events published on the Platform may be subject to access restrictions for reasons of capacity, age or other conditions established by the Organizer.
3.3. Capacity to contract
In order to purchase Tickets through the Platform, the User must be at least 16 years old and have sufficient legal capacity to contract under the legislation of their country of residence. Some Events may require a higher minimum age, in which case the Organizer shall expressly state this in the description of the Event.
By completing the purchase, the User declares that they meet the capacity requirements.
3.4. Validity of the GPC
These GPC are of indefinite duration and apply to all purchases made on the Platform. CULPASS reserves the right to amend them in accordance with section 14. The version in force at the time of each purchase shall apply to that transaction.
4. The Culpass intermediation model
CULPASS acts exclusively as a technology intermediary between the User and the Organizer. Its role consists of providing the technical infrastructure that allows the Organizer to publish and manage its Events and the User to purchase Tickets securely.
The contract for access to the Event is entered into directly between the User and the Organizer. CULPASS is not the organizer of any Event published on the Platform and assumes no liability whatsoever for the content, quality, conduct or cancellation of the Event, or for any incident related to it, which is the exclusive responsibility of the Organizer.
Accordingly:
- Claims relating to the conduct, content or cancellation of an Event must be addressed to the Organizer, whose contact details appear on the Event page.
- CULPASS may act as a facilitator in the handling of refunds when the Event is cancelled by the Organizer, as provided in section 10.
- CULPASS may suspend or cancel the account of an Organizer that breaches its obligations, but does not guarantee that any Event will take place.
The identity of the Organizer appears on the page of each Event under the profile name with which it operates on the Platform. CULPASS internally maintains the link between the public profile and the legal details of the Organizer.
5. Purchase process
5.1. Process steps
The purchase of Tickets through www.culpass.com follows this process:
- Selection: the User selects the Event and the type and number of tickets desired.
- Buyer details: the User fills in their personal details, at a minimum name and email address, and, where applicable, the additional data that the Organizer has configured in the Event form.
- Payment: the User selects the payment method and completes the transaction through the Stripe payment gateway.
- Acceptance: the User expressly accepts these GPC by ticking checkbox 1 and, optionally and independently, may consent to receiving the CULPASS newsletter by ticking checkbox 2 and to commercial communications from the Organizer and its Partners by ticking checkbox 3.
- Confirmation: CULPASS sends the purchase confirmation and the Ticket in digital format with a QR code to the email address provided by the User.
5.2. Order confirmation
The purchase is concluded at the moment CULPASS sends the confirmation email to the User. This email contains the summary of the purchase and the Tickets purchased.
If the User does not receive the confirmation within a reasonable time, they must check their spam folder and, if they cannot find it, contact CULPASS at sales@culpass.com.
5.3. Errors in the order data
The User is responsible for the accuracy of the data provided during the purchase process. If they detect an error in their order, they must notify it as soon as possible at sales@culpass.com so that CULPASS can assess the correction options available.
5.4. Availability hours
The Platform is available for the purchase of Tickets 24 hours a day, 365 days a year, except for interruptions due to technical maintenance or causes beyond the control of CULPASS.
6. The three acceptance checkboxes in the purchase process
6.1. Checkbox 1. Acceptance of the General Purchase Conditions
Ticking this checkbox is mandatory to complete the purchase. It means that the User has read, understands and fully accepts these GPC, the CULPASS Privacy Policy and Cookies Policy.
The legal basis for this acceptance is the performance of the contract of sale of Tickets, pursuant to Article 6.1.b of Regulation (EU) 2016/679 (GDPR/RGPD) and Article 1258 of the Spanish Civil Code (Código Civil). It does not constitute consent in matters of data protection for purposes other than the management of the purchase.
6.2. Checkbox 2. Subscription to the Culpass newsletter
Ticking this checkbox is voluntary and independent of the purchase. It means the User's express consent for CULPASS to send them electronic commercial communications about its services, news and promotions.
The User may withdraw this consent at any time by clicking on the unsubscribe link included in each communication or by sending an email to sales@culpass.com with the subject "UNSUBSCRIBE NEWSLETTER". Withdrawal shall not affect the lawfulness of communications sent previously.
6.3. Checkbox 3. Consent to communications from the Organizer and its Partners
Ticking this checkbox is voluntary and independent of the purchase. It means the User's express consent for the Event Organizer and the third parties it designates as its Partners or collaborators to send them commercial communications.
The User should bear in mind the following:
- The Organizer is the Data Controller of their data for this purpose. CULPASS acts solely as a technical channel for the collection and transmission of consent.
- The Organizer's Partners are third parties designated by the Organizer itself. CULPASS neither determines nor controls their identity. To find out who they are, the User must consult the Organizer's privacy policy, available through its contact details on the Event page.
- If the User consents, this will be recorded in the Event attendee report, so that the Organizer may exercise its commercial communication rights in accordance with the applicable regulations.
The User may withdraw this consent at any time by contacting the Organizer directly or by asking CULPASS to forward their request through sales@culpass.com.
Refusing to tick this checkbox has no effect on the purchase of the Ticket.
7. Prices and payment methods
7.1. Prices
Ticket prices are those published on the page of each Event at the time of purchase. Prices are expressed in euros and include, where applicable, the Value Added Tax (IVA) applicable under the Spanish legislation in force.
CULPASS may apply a service fee on the base price of the Ticket, which will be shown itemised to the User before the purchase is confirmed. The total price the User sees in the order summary is the final price they will pay, with no hidden additional charges.
In the exceptional event that a price is published with a typographical error, CULPASS reserves the right to cancel the order and offer the User the possibility of purchasing the Ticket at the correct price or receiving a full refund of the amount paid.
7.2. Payment methods
Payment for Tickets is made exclusively through the payment gateway of Stripe Payments Europe, Ltd., an entity established in Ireland, which ensures the security of the transaction by means of the SSL/TLS protocol. CULPASS does not store the User's complete payment data on its systems.
Stripe has its own privacy and security policies, available at stripe.com/es/privacy. CULPASS accepts no liability for the operation of the Stripe payment gateway.
7.3. Payment security
All transactions are carried out in a secure environment with SSL/TLS encryption. If CULPASS detects or suspects any anomaly or sign of fraud in a transaction, it reserves the right to cancel it for security reasons, informing the User at the email address provided.
8. Tickets and access to events
8.1. Format and delivery
Tickets are issued exclusively in digital format. After payment is confirmed, the User will receive, at the email address provided during the purchase, a message with the Ticket in PDF or image format, which incorporates a unique and non-transferable QR code.
The Ticket is the only valid pass for access to the Event. The User must present it at the entrance to the venue, either on a mobile device screen or printed on paper.
8.2. Use of the ticket
Each Ticket is linked to a single-use QR code. Once scanned at the entrance to the Event, the Ticket is invalidated for subsequent use. CULPASS and the Organizer accept no liability for access by unauthorised third parties who have obtained a copy of the Ticket through the User's negligence.
The resale of Tickets for profit is prohibited. CULPASS reserves the right to cancel Tickets that have been marketed outside the authorised channels.
8.3. Loss or non-receipt of the ticket
If the User does not receive the Ticket in their email, they must check the spam folder. If they still cannot find it, they may contact CULPASS at sales@culpass.com, which will provide a copy of the Ticket issued.
9. Right of withdrawal
In accordance with Article 103(l) of Royal Legislative Decree 1/2007 of 16 November approving the revised text of the General Law for the Defence of Consumers and Users, the purchase of Tickets for leisure, cultural or entertainment Events to be held on a specific date or during a specific period is expressly excluded from the right of withdrawal.
Accordingly, once the purchase is completed, the User may not exercise the right of withdrawal or request a refund of the amount paid on grounds of change of mind or change of plans, except in the cases provided for in section 10.
10. Event cancellation and refund policy
10.1. Cancellation by the Organizer
The cancellation of an Event is the exclusive responsibility of the Organizer. If the Organizer cancels an Event, the User shall be entitled to a full refund of the amount paid for the Tickets, in accordance with Article 51 of Royal Decree 2816/1982 of 27 August approving the General Regulation on Police Control of Public Shows and Recreational Activities (Reglamento General de Policía de Espectáculos Públicos y Actividades Recreativas).
The refund process will be handled through the Platform, charged to the Organizer's funds. CULPASS will provide technical facilitation of the refund, but the obligation to return the amount lies with the Organizer. If the Organizer does not have sufficient funds or does not process the refund, the User must claim directly from the Organizer.
10.2. Change of date or venue
If the Organizer substantially changes the date, venue or conditions of the Event, it will inform buyers through the Platform. The User may choose between keeping their Tickets for the new Event or requesting a refund within the period set by the Organizer in its communication. CULPASS will provide technical facilitation of this process where possible.
10.3. Refund request procedure
To request a refund for cancellation or substantial change of the Event, the User must:
- Contact the Organizer first, using the contact details given on the Event page.
- If they do not receive a reply within a reasonable time or the Organizer refuses to make the refund, they may contact CULPASS at sales@culpass.com stating in the subject "REFUND - [Event name]" and attaching the proof of purchase.
Refunds, where applicable, will be made using the same payment method used for the purchase, within a maximum of 14 calendar days from confirmation of the right to a refund.
10.4. Events held in part
Where an Event is held only in part, due to interruption, reduction of the programme or another similar circumstance, the right to a full or partial refund will depend on the conditions established by the Organizer and on the regulations applicable to each type of show. CULPASS does not determine these conditions.
10.5. Refunds at the initiative of Culpass
CULPASS may cancel a Ticket and proceed to refund it in the following cases: technical error in the issuance of the Ticket, duplicate charge or failure in payment processing. In these cases, CULPASS will contact the User and handle the refund directly.
11. Personal data protection
11.1. Data processed by Culpass as Data Controller
In compliance with Article 13 of Regulation (EU) 2016/679 (GDPR/RGPD), CULPASS informs the User about the processing of their personal data in the context of the purchase of Tickets. CULPASS, S.L., with NIF B67902593, processes the User's personal data – name, email address and purchase data – for the following purposes and on the following legal bases:
- Purchase management: management and processing of the order, issuance of the Ticket and service-related communications. Legal basis: performance of the contract, Article 6.1.b of the GDPR.
- Legal obligations: issuance of invoices and compliance with accounting and tax obligations. Legal basis: legal obligation, Article 6.1.c of the GDPR. Indicative period: 6 years.
- CULPASS newsletter: only if the User ticks checkbox 2. Legal basis: consent, Article 6.1.a of the GDPR, revocable at any time.
- Security and anti-fraud: fraud prevention and security of the platform. Legal basis: legitimate interest, Article 6.1.f of the GDPR.
Purchase data is retained for 5 years from the date of the Event. For complete information on the processing, retention periods, data processors and international transfers, please consult the CULPASS Privacy Policy.
11.2. Data processed by the Organizer as Data Controller
The Event Organizer receives, in its capacity as Data Controller, the data that the User provides during the purchase of the Ticket, including the additional data collected through custom forms that the Organizer has configured for its Event. CULPASS acts as Data Processor of this data, on behalf of and following the instructions of the Organizer.
To find out how the Organizer will process their data, the User must consult the Organizer's privacy policy, accessible through its contact details on the Event page. CULPASS is not responsible for the processing that the Organizer carries out with the User's data.
11.3. Post-event communication
Once the Event has taken place, the User may receive a single email from CULPASS, on behalf of the Organizer, requesting their assessment of the experience at the Event and on the Platform.
The User may object to receiving this communication by writing to sales@culpass.com.
11.4. Consent to communications from the Organizer and its Partners
If the User ticks checkbox 3 during the purchase process, they expressly consent to the Organizer and the third parties it designates as its Partners sending them commercial communications.
The Organizer is the Data Controller for this purpose. The User's data is not transferred by CULPASS to third parties for purposes other than those indicated in this clause.
11.5. User rights
The User may exercise their rights of access, rectification, erasure, restriction, portability and objection by contacting CULPASS at sales@culpass.com with the subject "DATA PROTECTION - EXERCISE OF RIGHTS". For data whose Controller is the Organizer, the User must contact the Organizer directly.
They may also lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD) at www.aepd.es.
12. Intellectual and industrial property
All content of the website www.culpass.com, including, without limitation, texts, images, logos, graphic design, source code and software, is owned by CULPASS or its legitimate licensors and is protected by intellectual and industrial property legislation. Its reproduction, distribution, public communication or transformation without the prior and express authorisation of CULPASS is prohibited.
The content of the Events, such as images, videos or descriptions, is the responsibility of the Organizer, who warrants that it holds the rights necessary for its publication on the Platform.
13. Limitation of liability
13.1. Liability of Culpass as intermediary
CULPASS acts as a technology intermediary and accepts no liability for:
- The content, quality, safety, conduct or holding of the Events.
- The acts or omissions of Organizers with regard to Users.
- Damages arising from the cancellation, modification or interruption of an Event for reasons attributable to the Organizer.
- The accuracy of the information published by the Organizer on the Event page.
13.2. Liability of Culpass for the intermediation service
CULPASS is liable only for damages caused to the User by technical failures directly attributable to the Platform in the purchase process, for example duplicate charges or incorrect issuance of Tickets, provided that the User notifies it as soon as possible.
13.3. Force majeure
Neither party shall be liable for failure to perform its obligations where this is the result of unforeseeable and unavoidable events or circumstances beyond its control, including, without limitation, natural disasters, pandemics declared by health authorities, acts of terrorism, decisions of government authorities or failures of telecommunications infrastructure.
14. Amendment of the GPC
CULPASS reserves the right to amend these GPC to adapt them to changes in legislation, case law or the business model. The version in force at the time of each purchase is the one applicable to that transaction.
Changes to the GPC will be notified to registered Users by email or by a notice on the Platform with reasonable advance notice. Continued use of the Platform after the changes enter into force will imply acceptance of the new version.
15. Governing law and jurisdiction
These GPC are governed by Spanish law, in particular by Royal Legislative Decree 1/2007, Law 34/2002 and the Civil Code.
For the resolution of disputes:
- Users resident in the European Union: consumers resident in a Member State of the European Union may bring proceedings before the courts of their place of habitual residence, in accordance with Article 18 of Regulation (EU) 1215/2012.
